Copyright and licence of use
This page explains who owns the rights in the materials you upload, what licence BrandForge receives to process them, and what rights you get in the posted content or the delivered website.
This English version is a translation provided for convenience. The Romanian version is the legally binding text and prevails in case of any difference between the two.

Rights in your materials
Everything you send us (information about the product and business, text, logos, trademarks, images or other materials) remains yours. So does your website’s domain. By sending materials to BrandForge, you declare that you have the right to provide them and to allow their use for the purpose of carrying out your order.
The licence granted to BrandForge for processing
For BrandForge to be able to provide the service ordered (posting content or developing a website), you need to grant BrandForge a limited, non-exclusive and temporary licence to use your materials, strictly for the purpose of processing, editing and delivering the order in question. This licence does not transfer ownership of your materials and does not allow them to be used for other purposes.
Rights in the delivered content or website
- Social media content: once a paid post has been published, you get the right to use that content on the accounts and for the purposes agreed in the order.
- The domain is yours: you buy it, and we help with the DNS settings to connect the website. You keep it whether you stay subscribed, end the subscription or buy the website; BrandForge acquires no right in it.
- The website on subscription: the code of each website is written specifically for that website. While the website is provided on subscription, its source code and implementation remain the property of BrandForge, which takes care of hosting and maintenance. You have the exclusive right to use the website, for the duration of the subscription, for the purposes agreed in the order; BrandForge does not supply it to other clients.
- Buying the website: you can buy, separately from the subscription, ownership of the website and its source code. The price decreases the longer your subscription has been running; we give you the exact amount on request. Once paid, the website and its entire source code become yours. We agree the arrangements after the buyout (for example, hosting and maintenance) together.
- If you cancel without buying the website: the website stays live until the end of the period already paid for, and may then be deactivated. The domain and your materials remain yours.
What is not transferred
The following remain the property of BrandForge and are not part of the delivered content or website (not even when you buy the website):
- working files used during processing (intermediate versions, editing projects);
- BrandForge’s own creative structures and working methods, used as working tools (not your website’s code, which is transferred in full on a buyout);
- the prompts used for artificial intelligence tools;
- BrandForge’s automations and internal tools, including their code;
- BrandForge’s own models and working methods.
Third-party assets, music, fonts
If third-party assets are used in creating the content or the website (licensed music, fonts, stock images or plugins), they remain subject to their own licences and terms of use, and BrandForge cannot transfer to the client more rights than it holds itself in those elements.
Trademarks, likeness and voice
Trademarks, and the likeness and voice of people used in a post or on a website, remain subject to the rights of their holders. If your brief involves trademarks, or other people’s likeness or voice, you are responsible for having the rights needed to use them, under the “Client materials” section of the Terms and conditions.
The separate portfolio agreement
BrandForge does not automatically use the result of your order in its own portfolio or in promotional materials. Such use happens only on the basis of a separate, optional agreement, which you can give or withdraw at any time, separately from accepting the Terms.
Reporting an infringement
If you believe that material published or used by BrandForge infringes your copyright or other rights, you can contact us at [email protected] with the following information:
- identification of the work or material in which you claim rights;
- identification of the disputed material (link, description or screenshot);
- proof, or a reasonable explanation, of the right claimed;
- your contact details;
- a statement of good faith regarding the report.
This is BrandForge’s own internal procedure, governed by Romanian law; it is not a DMCA procedure (specific to US law) and must not be interpreted as one.
